Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Business Detonator. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About Business Detonator
Business Detonator is an AI-powered marketing automation platform operated by Business Detonator LLC, a company organized under the laws of the State of Texas, United States (“Company,” “we,” “us,” or “our”). The platform automates content creation and publishing for small businesses, including blog posts, social media, and email campaigns (“Service”).
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. By using the Service, you represent and warrant that you meet these requirements.
3. Subscription Plans and Billing
3.1 Plan Tiers and Pricing
The Service is offered on a subscription basis. Available plan tiers include Starter ($47 bi-weekly / $97/mo / $970/yr), Builder ($97 bi-weekly / $197/mo / $1,970/yr), and Done For You ($147 bi-weekly / $297/mo / $2,970/yr). Current pricing is always displayed on our pricing page.
3.2 Billing Intervals
We offer three billing intervals: bi-weekly (every 14 days), monthly, and annual. The default billing option at checkout is bi-weekly. All intervals are recurring and auto-renew until cancelled in accordance with these Terms.
3.3 Initial Commitment Period
All new subscriptions are subject to a 6-month initial commitment period beginning on the date your paid subscription activates (after any free trial period). During this period, you agree to maintain your subscription and may not cancel except for material breach by Business Detonator LLC that is not cured within 10 business days of written notice. After the initial 6-month period, your subscription converts to a month-to-month arrangement.
3.4 Rate Lock
Your subscription rate is locked for the duration of your initial 6-month commitment period. After the commitment period ends, we reserve the right to adjust pricing upon no less than 60 days' written notice to the email address on your account. If you do not wish to continue at the adjusted rate, you may cancel in accordance with Section 4 below.
3.5 Auto-Renewal
Subscriptions renew automatically at the end of each billing period unless cancelled in accordance with these Terms. By providing payment information, you authorize us to charge your payment method for each renewal period at the then-current rate.
3.6 14-Day Free Trial
New accounts may receive a 14-day free trial. No credit card is required to begin the trial. At the end of the trial period, you will be prompted to enter payment information to continue. If you do not provide payment, your account will be downgraded or suspended. Only one free trial per person or business entity is permitted. The 6-month commitment period begins when billing activates, not at the start of the trial.
3.7 Payment Processing
Payments are processed by a third-party payment processor (Stripe). We do not store your full credit card or bank account information. You agree to keep your payment information current and accurate. ACH bank account payments may be accepted where available.
3.8 Taxes
Subscription fees do not include applicable sales taxes, VAT, or similar charges. You are responsible for any such taxes imposed on transactions under these Terms.
4. Cancellation Policy
After your initial 6-month commitment period, you may cancel your subscription by providing 30 days' written notice via your account settings or by emailing contact us. Your subscription will remain active for the full 30-day notice period, and you will be charged for any billing cycles that fall within that period. No service is provided after the cancellation effective date and no refunds are issued for the notice period.
Cancellation attempts during the initial 6-month commitment period are not permitted except as described in Section 3.3. Refund eligibility is governed by our Refund Policy.
5. Acceptable Use Policy
You agree not to use the Service to:
- Publish content that is defamatory, harassing, threatening, or illegal
- Violate any applicable local, state, national, or international law
- Transmit spam, phishing messages, or unsolicited commercial communications
- Infringe on the intellectual property rights of others
- Attempt to gain unauthorized access to any part of the Service or related systems
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Use the Service in a way that interferes with or disrupts the integrity of the platform
We reserve the right to suspend or terminate accounts that violate this policy, with or without prior notice.
6. Content Ownership
6.1 Your Content
You retain full ownership of all business content you provide to the Service, including your brand assets, business information, uploaded materials, and published outputs generated on your behalf. You grant Business Detonator a limited, non-exclusive license to use such content solely to provide the Service to you.
6.2 Platform and Intellectual Property
Business Detonator LLC owns all rights, title, and interest in the platform, including its software, design, AI workflows, automation logic, proprietary prompts, and all related intellectual property. Nothing in these Terms transfers ownership of the platform or its underlying technology to you.
7. Data Handling and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime outside of our control. We are not liable for any loss arising from service interruptions.
9. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Business Detonator LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of revenue, loss of data, or loss of business opportunities, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that AI-generated content will meet any specific standard of quality or accuracy.
12. Indemnification
You agree to indemnify, defend, and hold harmless Business Detonator LLC and its affiliates from and against any claims, liabilities, damages, judgments, and costs (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance.
